Terms of Service

These Terms of Service constitute a binding agreement between you (the "Vendor" or "Partner") and Mahad Manpower Services Pvt. Ltd. (the "Company"). By registering and using the Mahad Partner Portal, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety.

1. Business-to-Business (B2B) Nature

This platform is exclusively a Business-to-Business (B2B) network designed for registered manpower agencies, recruitment firms, and licensed vendors. It is not a consumer-facing platform for individual job seekers or direct candidates.

By registering as a Partner, you represent and warrant that:

  • You are a legally registered business entity authorized to provide manpower services
  • You possess all necessary licenses and permits to operate in your jurisdiction
  • You have the authority to enter into this agreement on behalf of your organization
  • You will only use this platform for legitimate business-to-business recruitment and allocation purposes

2. Independent Contractor Status

You acknowledge and agree that:

  • Your agency/firm acts independently and is not an employee, agent, or legal representative of Mahad Manpower
  • Mahad does not exercise control over the manner or means by which you perform your services
  • You are solely responsible for compliance with all applicable labor laws in your jurisdiction
  • You maintain complete operational and financial independence from Mahad Manpower
  • Any employment relationship between you and your candidates is independent of Mahad Manpower
  • Mahad Manpower holds no liability for disputes between you and your employees or candidates

3. Ministry of External Affairs (MEA) & Legal Compliance

You agree to adhere strictly to:

  • Ministry of External Affairs (MEA) Guidelines: All candidates must be screened and registered in compliance with MEA protocols established by the Government of India
  • GCC Country Labor Laws: Vendors must ensure compliance with the labor laws, immigration regulations, and employment standards of the destination Gulf Cooperation Council (GCC) countries including but not limited to UAE, Saudi Arabia, Qatar, Kuwait, Bahrain, and Oman
  • Pre-departure Orientation: All candidates must undergo mandatory pre-departure orientation as mandated by MEA regulations
  • Documentation Standards: All candidate documentation must meet international standards and GCC employer requirements
  • Sanctions Screening: All candidates must be screened against international sanctions lists and blacklists

Failure to comply with MEA guidelines or GCC labor laws may result in immediate suspension of your partner account and forfeiture of applicable security deposits.

4. Visa Allocation & Demand Management

You acknowledge that visa allocations and job demands are subject to the following conditions:

  • Sole Discretion: Mahad Manpower retains the sole and absolute discretion to allocate, modify, or cancel visa demands based on GCC employer requirements, candidate availability, and market conditions
  • Demand Modifications: Mahad reserves the right to change job specifications, salary ranges, or qualification requirements at any time with reasonable notice
  • Cancellation Rights: Mahad may cancel or suspend any demand allocation if it becomes non-viable or if compliance issues arise
  • No Guarantee: Allocation of demands does not guarantee visa approval or candidate placement
  • Timeline Adherence: Partners must mobilize candidates within agreed timelines. Delays may result in demand reassignment to other vendors

5. Violation of Terms & Account Suspension

Mahad Manpower reserves the right to immediately suspend or terminate your account if you:

  • Violate MEA guidelines or GCC country labor laws
  • Provide false or fraudulent documentation or information
  • Engage in malpractice, discrimination, or unethical business conduct
  • Fail to meet agreed-upon timelines or quality standards
  • Misuse the platform for unauthorized purposes
  • Default on financial obligations or security deposits

6. Limitation of Liability

To the fullest extent permitted by law, Mahad Manpower shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this platform or any business dispute with other vendors or employers. Mahad's total liability shall not exceed the total fees paid by you in the preceding 12 months.

7. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in New Delhi, India.

Before initiating legal proceedings, parties agree to attempt resolution through mutual negotiation and, if necessary, mediation.

Mahad Manpower reserves the right to modify these Terms of Service at any time. Continued use of the Partner Portal constitutes acceptance of any modifications. Major changes will be communicated via email.
