Refund & Cancellation Policy

This Refund & Cancellation Policy outlines the terms governing security deposits, performance bonds, and refund procedures for partners of the Mahad Manpower Partner Portal. All refunds and cancellations are subject to the conditions specified herein.

1. Vendor Security Deposits

Mahad Manpower may collect security deposits or performance bonds from vendors as a prerequisite to securing visa allocations. These deposits serve as:

  • A guarantee of good faith commitment to fulfill allocated visa demands
  • A security against operational failures, non-compliance, or candidate quality issues
  • A commitment to adhere to Service Level Agreements (SLAs) and MEA guidelines
  • A hedge against damages caused by vendor default or malpractice

Important: Security deposits are held in designated Mahad Manpower bank accounts and are strictly non-refundable until all contractual obligations have been fulfilled or the partnership is formally discontinued.

2. Service Level Agreements (SLA) & Obligations

By accepting visa allocations, you agree to the following SLA timelines and quality standards:

Mobilization Timeline:

  • Candidates must be medically and trade-tested within 45-60 days of visa block allocation
  • Medical reports must meet international standards and GCC employer specifications
  • Trade certifications must be verified and approved before submission to employers
  • All documentation must be submitted within the agreed timeline without extensions unless explicitly approved

Quality Standards:

  • Candidates must possess the minimum qualifications specified in the job demand
  • Medical fitness certificates must be current and from GAMCA or approved diagnostic centers
  • All identity documents must be authentic and verified
  • Candidates presented must match the profile (trade, age, experience) of the demand
  • No misrepresentation or document fraud will be tolerated

Compliance Obligations:

  • All candidate data must comply with MEA registration and documentation standards
  • Vendors must conduct pre-departure orientation and training as mandated by MEA
  • All candidates must clear international sanctions and blacklist screening
  • Vendors must maintain regular communication with Mahad and GCC employers
  • Any concerns raised by employers must be addressed within 48 hours

3. Security Deposit Forfeiture

Mahad Manpower retains the right to forfeit partial or full security deposits in the following circumstances:

Non-Mobilization (Candidate Supply Failure):

  • If the vendor fails to mobilize the agreed number of candidates within the stipulated 45-60 day SLA window
  • Forfeiture: 50% of security deposit or actual operational damage cost (whichever is higher)

Quality Issues & Rejection:

  • If GCC employers reject candidates due to falsified documents, mismatched profiles, or medical unfitness
  • If candidates presents with forged certifications or fraudulent qualifications
  • Forfeiture: 25-100% of security deposit based on severity and employer loss

Regulatory Non-Compliance:

  • If vendor fails MEA compliance audits or violates Government of India guidelines
  • If candidates are found on international sanctions or fraud databases
  • If pre-departure training and orientation records are not maintained
  • Forfeiture: Full security deposit confiscation; potential legal action

Malpractice & Contract Breach:

  • If vendor engages in fraud, misrepresentation, or unethical business conduct
  • If vendor breaches confidentiality or shares employer information with competitors
  • If vendor violates any material term of the partnership agreement
  • Forfeiture: Partial or full deposit confiscation; account suspension

Candidate Non-Reporting / Overstay:

  • If deployed candidates fail to report to the GCC employer or overstay in the initial location
  • If the vendor fails to track and manage candidate performance
  • Forfeiture: 50-100% based on employer losses and incident severity

4. Legitimate Refund Process

Refunds are processed if all of the following conditions are met:

Refund Eligibility:

  • All allocated visa demands have been successfully fulfilled with candidates deployed and working
  • No compliance violations, document fraud, or quality issues have been reported
  • GCC employers have confirmed candidate satisfaction and contract completion
  • The partnership has been formally concluded with mutual written consent
  • No pending disputes or claims against the vendor

Refund Processing Timeline:

  • Step 1 (Submission): Vendor submits refund request with all supporting documentation
  • Step 2 (Verification): Mahad verifies all obligations have been met (5-7 business days)
  • Step 3 (Approval): Approved refunds are released (10-15 business days after verification)
  • Step 4 (Processing): Bank transfer completed within 30-45 days from approval date
  • Total Time Frame: 45-60 days from submission to release of funds

Refund Payment Method:

  • Refunds are released via bank transfer to the bank account associated with your registration
  • We recommend maintaining the same bank account throughout the partnership for seamless processing
  • Bank transfer charges, if any, are borne by the vendor's bank

5. Non-Refundable Charges & Deductions

The following charges and deductions are non-refundable and will be retained by Mahad Manpower:

  • Administrative Processing Fees: One-time account setup and partner onboarding fee (if applicable)
  • Operational Charges: Visa processing, employer coordination, and document management costs
  • Regulatory Compliance Fees: MEA registration, documentation verification, and government filing charges
  • Portal Subscription/Maintenance: Annual or monthly platform usage fees
  • Forfeiture Amounts: Any amounts forfeited due to non-compliance or contract breach
  • Dispute Settlement Costs: Legal or mediation costs related to vendor disputes

6. Early Account Termination & Refunds

If a vendor wishes to terminate their partnership before all allocated demanding have been fulfilled:

  • Notice Period: Vendors must provide 30 days written notice of intention to close account
  • Pending Demands: All pending visa demands must be either fulfilled or returned to Mahad
  • Outstanding Obligations: Any incomplete candidate mobilizations will result in partial forfeiture
  • Refund Amount: Only the portion of security deposit not forfeited will be refunded
  • Processing Time: Refund processed 15-30 days after final obligation closure

Early Termination Without Notice: If a vendor abandons the partnership without notice, Mahad retains all security deposits as operational damages.

7. Refund Disputes & Escalation

If you disagree with a refund decision or forfeiture amount:

  1. Submit a formal dispute notice to info@mahadmanpowers.co.in within 15 days of the decision
  2. Provide detailed documentation supporting your claim for refund or reduced forfeiture
  3. Mahad will review the dispute and respond within 10 business days
  4. If unresolved, both parties may pursue mediation or legal proceedings as per the Terms of Service

Note: Disputes must be filed in writing with supporting evidence. Informal complaints or WhatsApp messages will not be considered official dispute notices.

8. Policy Updates & Changes

Mahad Manpower reserves the right to update this Refund & Cancellation Policy. Material changes will be communicated via email with 30 days notice. Continued partnership constitutes acceptance of updated terms.
